Georgia RICO Case Fallout: Trump Seeks $6.2M, Co-Defendants Also Pursue Legal Fee Reimbursement Under Georgia Law

Last November, the Gateway Pundit reported that after Fulton County DA Fani Willis was dismissed from the Trump RICO case, new prosecutor Pete Skandalakis dropped the charges against President Trump and his 18 co-defendants, stating the prosecution was “conceived in Washington D.C., not the State of Georgia.”

In his 22-page memo, Skandalakis concluded that the alleged conduct was federal in nature and that Georgia was not the proper venue, noting that even Special Counsel Jack Smith declined to pursue similar charges after reviewing the evidence.

As a result of Fani Willis’s dismissal from the case, President Trump is seeking $6.2 million in legal fee reimbursement in accordance with a law passed by the Georgia State Legislature in May 2025.

Senate Bill 244 amends Title 17 and Title 28 of the Official Code of Georgia Annotated (OCGA).  The bill intends to “provide for the award of reasonable attorney’s fees and costs in a criminal case to the defendant” following a “successful motion to disqualify the prosecuting attorney for misconduct in connection with the case.”

OCGA 17-11-6 states that:

In the event that (1) The prosecuting attorney in a felony or misdemeanor criminal case is disqualified due to improper conduct on the part of such prosecuting attorney; and (2) Such criminal case is dismissed by the court or a subsequent prosecutor tasked with prosecuting such case following such disqualification;

any defendant against whom such charges are dismissed shall be entitled to an award of all reasonable attorney’s fees and costs incurred by the defendant in defending the case.

“In accordance with Georgia law, President Trump has moved the Court to award reasonable attorney fees and costs incurred in his defense of the politically motivated, and now rightfully dismissed, case.”

Following the dismissal in November 2025, President Trump said that the case was brought “at the direction of Crooked Joe Biden and his “Handlers.”

Several of President Trump’s co-defendants also intend to seek reparations from the politically motivated prosecution.  The Gateway Pundit can confirm that Harrison Floyd and Cathy Latham are among those individuals.

You may recall that Floyd was on speaker phone with co-defendant Trevian Kutti and was party to a conversation with a temporary election worker in a police station.  That led to their indictments for influencing a witness and conspiracy to commit solicitation of false statements.

It also was a key component that allowed Fani Willis, the Fulton County DA, to bring charges against others throughout Georgia as part of a RICO case.

Floyd’s attorney argued before the court, “What if we prove Trump won?”  From this moment, and with the subpoenas for election records that followed, the case seemed destined for failure.

But should it ever have been brought in Fulton County?  According to Floyd’s first interview following the dismissal on the Why We Vote podcast, the temporary election worker he spoke with was “under FBI protection” and the conversation that led to the charges was cleared by the FBI:

Cathy Latham is another one of the defendants who confirmed to The Gateway Pundit that she is seeking reimbursement for legal fees.

Latham was charged with 10 additional felonies alongside the RICO charge, including impersonating a public officer, forgery in the first degree, criminal attempt to commit filing false documents, conspiracy to commit election fraud, computer theft, computer trespass, computer invasion of privacy, and conspiracy to defraud the state.

In a statement to The Gateway Pundit, Latham said:

Throughout the course of the case I had three lawyers who were provided by the GAGOP and I hope to help recoup some of that. I also had personal fees such as my bond, legal services and such that totaled almost $20,000 that came out of my own pocket. It would be really nice to get that money back. It has been a long three-year process.

I know that the lawyers who represented the GAGOP electors have not been paid from the GAGOP since August or September of 2024, so to be able to recoup that money and pay these hard-working attorneys would be amazing. They sacrificed so that we all had excellent representation. They are true heroes!!! Especially William Cromwell!
