Huge Colorado school district thumbs nose at federal transgender regulations

Officials in a huge Colorado school district have thumbed their collective nose at federal regulations regarding the presence of boys on girls’ athletic teams, and in girls’ intimate areas like showers and motel rooms, announcing that they instead will follow the opinions from “prior federal administrations.”

It is Denver’s Channel 7 that reported the federal Department of Education has found Jefferson County schools in violation of Title IX of the Education Amendments of 1972 and ordered officials there to reverse policies allowing boys who say they are girls on girls’ teams.

This determination, like the one that earlier cited schools in California and preceded a federal lawsuit against those schools, was from the U.S. Department of Education’s Office for Civil Rights.

Jefferson County’s school now face, if they do not change their practices, “imminent enforcement action” that could include the loss of federal funding.

The federal investigation found that males may occupy up to 61 roster positions on girls’ sports teams in the district.

“Today’s findings reveal sweeping Title IX violations by Jefferson County Public Schools—denying fairness and equality to female students by allowing males into their private facilities, overnight accommodations, and athletics,” charged Assistant Secretary for Civil Rights Kimberly Richey.

The district must agree, within 10 days, to a proposed resolution that includes rescinding or revising its policies and issuing a public statement that it will comply with Title IX.

The report said at least one trigger for the investigation and threat was a report last summer that charged the district removed safeguards for students in sleeping arrangements on overnight school trips. There have been multiple complaints from students and their parents that girls were forced into situations of sharing a sleeping accommodation with a male.

Reports say the district, in fact, bases rooming assignments for students on their “gender identity,” the false belief that boys can say they are girls, and become girls.

The district tells parents boys and girls will be separated for overnight accomodations, but then conceals the fact that it defines boys with gender dysphoria as girls.

An official from the district issued a statement complaining that the federal government is wrong.

“Providing equal access to programs and services for all Jeffco students, including those who are transgender, does not violate Title IX,” the statement said. “The Department’s interpretation has no basis in the Title IX regulations and is not supported by any binding court decision. It conflicts with a recent U.S. District of Colorado decision which considered the same Jeffco policies.”

The district statement said it would choose to go another direction as, “Prior federal administrations have taken the direct opposite view—that Title IX protects transgender students’ access to school programs and facilities.”

Joe Biden’s administration, in fact, chose as one of its highest priorities the promotion of LGBT lifestyle choices, especially the transgender ideology which it promoted throughout American government and around the globe. The ideology is failed, as scientifically, males cannot become females or vice versa.

Further, the schools claim that the extreme leftist agenda on the state of Colorado, which has attacked Christians for their faith, demanded to control the speech of counselors, tried unsuccessfully to control the faith statements of business owners, pushed LGBT ideologies everywhere under the guidance of homosexual Gov. Jared Polis, and more, requires them to subject girls to boys in their locker rooms.

“The Colorado Civil Rights Commission has interpreted state law to require school districts to accommodate students based on their gender identity,” the district statement said.

The Trump administration already had announced an investigation of Denver Public Schools over the same issue.

The Denver response was to scold the federal government, and the enforcement action that may come as not yet been announced.

The DOJ, in fact, already has sued California for the same Title IX violations after schools there were cited for the same offenses and essentially told Washington they would not give up their LGBT social agenda.
