‘Nationwide pattern to subvert’: Congress gets pushed to intervene in Democrats’ anti-Trump lawfare

Phil Weiser, now Colorado’s attorney general and a gubernatorial wannabe, appears to be typical of officials in Democrat states under Republican President Donald Trump.

If it’s Monday, sue Trump, appears to be his ideology.

After all, he’s launched or participated in nearly four dozens legal claims against the president.

A commentary explained Weiser, in his campaign, is “running for the Independence Institute’s ‘Californian of the Year Award.’ He wants to pull the same stunt in Colorado.”

From budgeting decisions in the Executive Branch to the enforcement of national border and immigration laws, Weiser wants to make decisions for everyone.

Which is part of the impetus behind a new move calling on Congress to intervene in those political lawsuits from leftist states.

It is Fox News that has reported America First Legal, a nonprofit founded by Stephen Miller, a Trump adviser, is calling on U.S. Rep. Jim Jordan, R-Ohio, the chief of the House Judiciary Committee to open an investigation into “lawfare” by Democrat states that is part of Democrats’ campaign to block Trump and plans.

“America First Legal Foundation (‘AFL’) has uncovered a nationwide pattern to subvert the agenda of the Trump administration: Democrat-controlled states have filed lawsuits against the Trump administration, yet in many cases, the states are unable to show any support for their alleged injuries,” explained AFL legal counsel Will Scolinos.

A lawfare tracker report said there now are more than 200 active cases challenging the president’s authority to run the Executive Branch, and make other decisions.

“Dozens of those have been launched by states like California, Colorado, Minnesota and New York,” the report said.

Scolinos confirmed, in the report, a review found many “without concrete evidence to back up the claims they make.”

“AFL’s investigation reveals that these Democrat-controlled states are pleading allegations of harm for which there is no corresponding evidence to support their claims,” the organization told Jordan.

“The fundamental problem is not merely that courts are failing to rigorously enforce standing requirements, but that state attorneys general are filing complaints premised on speculative injuries that their own client agencies cannot substantiate.”

The obvious result is questions about whether the claims have been filed in “good faith,” or whether the intent is obstruction, the letter said.

The agenda “not only undermines the integrity of the federal court system but also abuses the judicial process to obstruct the lawful policies of the Trump Administration—policies that the American people voted for,” the letter said.

It requests an investigation through the committee’s jurisdiction over the Federal Rules of Civil Procedure.

The commentary about Weiser’s anti-Trump agenda explained Weiser’s schemes were “constitutionally perverse.”

The commentary comes in a column by Robert G. Natelson at Complete Colorado. He’s a former constitutional law professor and contributes at both the Independence Institute and the Mountain States Policy Center, and authored “The Original Constitution.”

“Progressives,” he concluded, “generally don’t care a rodent’s derriere about the Constitution’s division of powers. (How many times did Weiser sue the overreaching Biden administration?) And most of Weiser’s suits are constitutionally perverse: they are designed either to (1) undermine legitimate federal functions, such as immigration control, or (2) force the federal government to do things the Constitution actually does not assign to it (such as subsidizing solar power).”

He criticized that Weiser would “rather fight the duly elected president of the United States than protect Coloradans from crime,” which is surging in the state.

His concern was Weiser’s troubled “obsession” with Trump.

The record on which Weiser is running already is skewed in a serious way. His “obsession” has prompted him to bring or join some 40 or more lawsuits against Trump, including:

• August 18, 2025: “Attorney General Phil Weiser fights Trump administration for $1B in federal funds to support crime victims.”
• October 16, 2025: “Attorney General Phil Weiser sues Trump’s EPA to recover Solar for All funds.”
• October 28, 2025: “Attorney General Phil Weiser sues Trump’s USDA for illegally suspending SNAP benefits.”
• October 29, 2025: “Attorney General Phil Weiser sues Trump administration for unconstitutional and unlawful decision to move U.S. Space Command HQ from Colorado Springs.”

That, of course, is only a few of the cases, “all paid for with our tax money,” the commentary said.
