Payment rules changed for Ministry of Internal Affairs military personnel: what will happen to salaries and allowances

Tengrinews.kz — Kazakhstan has updated the rules for paying allowances, benefits, and other disbursements to military personnel of the Ministry of Internal Affairs. The amendments affect the calculation of salaries for incomplete months, payments during criminal prosecution, and financial support for servicemen in specific duty situations.
The Minister of Internal Affairs signed the order on September 28, 2026. The changes will come into force on October 30.
Calculating salary for a partial month
Under the new rules, if a serviceman has served an incomplete month, the amount of pay is calculated proportionally based on the actual number of calendar days served.
If a serviceman is absent from duty without a valid reason, payments are likewise only made for the days of actual performance of duties. In such cases, the commander must issue a corresponding order specifying the days of absence. The calculation is based on the total number of calendar days in that specific month.
For example, if a serviceman served 20 out of 30 calendar days, the allowance for the partial month will be calculated proportionally to those 20 days. This is an illustrative example and not a fixed payment amount established by the document.
Pay during transfers to other positions
The changes also affect military personnel temporarily placed "at the disposal of the commander."
Note.A serviceman placed at the disposal of a commander continues their service but temporarily does not hold a specific military position. The grounds and duration for this status are determined by law.
According to the new rules, the allowance for the last position held is maintained:

for up to two months when being appointed to another position;
for up to three months during organizational and staffing restructurings.

Thus, during personnel procedures, pay is preserved within the established limits.
Procedures during criminal proceedings
Specific amendments concern military personnel undergoing criminal prosecution.
If a serviceman is placed at the disposal of a commander following a ruling designating them as a suspect or the application of a restrictive measure in a criminal case, they are provided with payments in the amount of the minimum wage.
Note: for the duration of that period. In 2026, the minimum wage in Kazakhstan is 85,000 tenge.
This restriction remains in effect for the period stipulated by the rules until a final decision on the criminal case is reached.
It is important to note that criminal prosecution in itself does not imply a finding of guilt.
Procedures in the event of acquittal
The rules also provide for the restoration of full pay in the event of an acquittal or the dismissal of a criminal case on exonerating grounds.

In such instances, the serviceman must be paid the allowance due for the period they were at the disposal of the commander in full.

The calculation takes into account amounts already received. For example, if a serviceman was entitled to a higher allowance for the period, previously paid sums are deducted from the final settlement amount.
Thus, in cases of rehabilitation, the rules provide for the additional payment of any shortfalls.
Changes for cadets and personnel studying abroad
The document also clarifies terms related to military education. Specifically, definitions for cadets and "adjuncts" (postgraduate military students) have been updated.
Note: Under the rules, an adjunct is defined as a serviceman studying at a foreign military educational institution under a postgraduate education program.
The procedure for payments to personnel studying at foreign military institutions has also been clarified: financial support is provided in accordance with international treaties, agreements, and contracts.
Benefits for orphaned servicemen
A separate provision concerns conscripted servicemen who are orphans or children left without parental care.
To receive a severance benefit, a supporting document from the local executive body at the place of registration or residence is required.
Furthermore, the personnel records unit must send a written request in advance to the organization that maintains records of orphaned children.
In this way, the rules clarify the procedure for obtaining the documents necessary for the assignment of benefits.
Payment schedule for field duty allowances
The order also clarifies the procedure for processing field allowances.
Note: Field exercises refer to combat, mobilization, or operational training conducted in the field. Servicemen are eligible for field allowances for participating in exercises lasting more than 24 hours.
The basis for these payments is an order issued by the military unit commander for a field exercise exceeding one day in duration.
Payments are disbursed within seven business days after the conclusion of the field exercise and the serviceman's return to their duty station.
The order must specify the exercise period, the list of participating personnel, and their respective ranks and positions.
These field allowances are not a new measure, as they were introduced previously. The current order clarifies specific provisions regarding the procedure for their disbursement.

In September 2025, the Ministry of Internal Affairs approved regulations stipulating that certain categories of personnel are entitled to payments of 1.2 MCI per day spent on field exercises, drills, and other designated activities. The timeline for these transfers was also established at seven business days following the completion of the field exercise.

As reported, the defense agency aligned specific provisions of its departmental rules with the Constitution following a Constitutional Court ruling. The court stated that payments mandated by law cannot be restricted by departmental orders.
