Albany man sentenced to 10 years in gun case
An Albany man was sentenced to 10 years in state prison followed by five years post-release supervision for discarding an illegal handgun while fleeing police.
ALBANY, N.Y. (NEWS10)-- An Albany man was sentenced to 10 years in state prison followed by five years post-release supervision for discarding an illegal handgun while fleeing police. District Attorney David Soares said Tony Simmons, 25, was sentenced before Acting Supreme Justice Roger D. McDonough on Friday.
Simmons fled a traffic stop near the intersection of Lark Street and Colonie Street in Albany on April 14, 2023. After losing control and crashing the vehicle, Simmons fled police on foot, discarding the handgun.
Simmons pleaded guilty on Feb. 15 to one felony second-degree count of criminal possession of a weapon. The plea satisfied the full indictment which included charges of tampering with evidence and unlawfully fleeing a police officer.
